The Explorest Travel Advisor Incentive Program is governed by Florida Seller of Travel laws (Chapter 559, Part XI, Florida Statutes).  Participants must:

• Be at least 18 years of age.
• Maintain any required licenses, certifications, or registrations under their state of registration law.
• Agree to comply with all applicable legal and ethical standards for selling travel .
• Eligibility may be subject to periodic review, and Explorest Travel reserves the right to revoke membership at any time.

Florida law requires transparency in the calculation and payment of commissions. Participants will receive detailed commission statements for each booking.  Payments will be made within 14 business days after the client’s trip completion, provided no cancellations, disputes, or refunds are pending.  Accounts in default will have their commission and bonus payouts applied to the account.  Any remaining funds will be paid in accordance with the payment terms previously outlined.

“Safari My Way”, Private Custom Safaris

“Safari My Way, Private Custom Safaris” refers to individually designed safari travel experiences created by Explorest Travel in direct consultation with the client. These safaris are hand-crafted to reflect the unique preferences, interests, and travel goals of each client, ensuring a personalized and exclusive journey throughout select African destinations. Each itinerary may include customized routing, privately guided excursions, luxury accommodations, tailored activities, and premium transport services. All components of the itinerary are subject to availability and the terms and conditions of Explorest Travel and its affiliated service providers.

Safari My Way, Private Custom Safaris commissions are based on the Net Confirmed Booking Value.

For the sake of this program, an Agency is defined as an entity that is operating in accordance with local, state, and federal laws governing the sale of travel services, including maintaining required licenses, registrations, and certifications (e.g., Florida Seller of Travel laws).  To ensure proper credit for all Confirmed Bookings, the Agency is responsible for providing Explorest Travel with its IATA code or verification number, its head office physical and mailing address, and list of agents who will book travel.  Failure to provide this information may result in forfeiture of commission payments, commission tier overrides, and bonus incentives.

Confirmed Net Booking Value  refers to the total value of a client’s confirmed booking with Explorest Travel, calculated excluding any applicable taxes, service fees, government-imposed charges, or other non-commissionable amounts. This value represents the portion of the booking that is eligible for commission or incentive calculations, as determined by Explorest Travel.

A Confirmed Booking refers to a travel reservation made through Explorest Travel for which the client has remitted full payment, including all applicable fees, taxes, and charges. A booking is deemed confirmed when it is no longer eligible for cancellation or modification without the full forfeiture of all monies paid by the client, in accordance with the applicable cancellation and refund policies.

Bonuses are awarded to travel advisors or agents for achieving predefined performance targets, which may include, but are not limited to, group bookings, luxury travel reservations, or other qualifying sales as specified in applicable promotional materials or incentive programs. All bonus earnings are subject to the terms and conditions of the associated promotion and are contingent upon full compliance with all applicable Florida travel laws and regulations, including but not limited to, timely disclosure of booking details and accurate representation of services offered. Bonus payouts shall be issued in accordance with the standard commission payment schedule and via the same payment method as standard commission disbursements..

The Advisor Referral Program is a referral incentive program administered by Explorest Travel whereby a registered travel advisor (“Referring Advisor”) may refer a new travel advisor (“Referred Advisor”) to establish a business relationship with Explorest Travel. The program rewards the Referring Advisor with a one-time referral bonus for each eligible Referred Advisor who meets the program requirements.

Priority support includes expedited responses, dedicated account representatives, and assistance with resolving booking issues.  Florida law requires fair treatment of all participants. Explorest Travel ensures that all travel advisors receive equal access to resources and support.  Special perks, such as access to exclusive deals, are provided in compliance with Florida regulations on promotional transparency.

Program Exclusions

Bookings that are subsequently canceled, refunded, or subject to chargebacks shall be excluded from eligibility for any commissions or bonus compensation. Additionally, bookings made at discounted rates, as part of promotional packages, or through third-party platforms shall not qualify for commissions or bonuses unless explicitly authorized in writing by Explorest Travel. All eligibility determinations shall be made at the sole discretion of Explorest Travel.

Payment Terms

All commission and bonus payments shall be disbursed via direct deposit or another approved payment method as designated by the participant during the registration process. It is the sole responsibility of the participant to provide accurate and up-to-date payment information. Explorest Travel shall not be liable for delays resulting from incomplete or incorrect payment details. In accordance with applicable Florida law, Explorest Travel is committed to ensuring timely payment of commissions and shall process all eligible payments within the agreed-upon timeframe, subject to the terms and conditions herein.

Program Modifications

Explorest Travel reserves the right, at its sole discretion, to modify, suspend, or terminate the program, in whole or in part, at any time and for any reason. Any such changes shall be communicated in accordance with applicable Florida law, with reasonable advance notice provided to participants where required. Modifications shall not apply retroactively and shall not affect commissions or bonuses that have been duly earned and vested prior to the effective date of such changes.

Misconduct and Disqualification

Any fraudulent activity, including but not limited to the misrepresentation of bookings, clients, or related information, shall result in immediate disqualification from the program. Participants are required to act in an ethical and transparent manner in all transactions, in accordance with applicable Florida law. Failure to comply with these obligations may result in the forfeiture of all program benefits, including commissions and bonuses.

Participants who are disqualified may request a review of the decision by submitting a written appeal to Explorest Travel within thirty (30) days of receiving notice of disqualification. All appeals will be reviewed at the sole discretion of Explorest Travel, and decisions rendered shall be final.

Legal Compliance and Dispute Resolution

This program shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. All participants are required to comply with all applicable Seller of Travel laws for the respective registration state and related consumer protection regulations.

Any disputes, claims, or controversies arising out of or relating to this program shall be subject to the exclusive jurisdiction of the state or federal courts located in Broward County, Florida.

In the event of a dispute, the participant must provide written notice to Explorest Travel within thirty (30) days of the occurrence giving rise to the dispute. Explorest Travel will conduct a timely investigation and respond in accordance with applicable Florida law.

If the parties are unable to resolve the dispute through direct communication, such dispute shall be submitted to final and binding arbitration in accordance with the laws of the State of Florida. The arbitration shall be conducted in Broward County, Florida, before a single arbitrator, and administered in accordance with the applicable rules of the American Arbitration Association or similar body, as determined by Explorest Travel.

Participants expressly waive the right to participate in any class-action lawsuit or class-wide arbitration related to the program.
